Mihalca Homes

House Rules & General Information
Terms and Conditions (T&C).

Applicability & Inclusion.

Valid for all reservations of accommodations offered by Mihalca Homes GmbH · Effective as of June 2026

These House Rules & Terms and Conditions are an integral part of every lodging/rental agreement with Mihalca Homes GmbH (hereinafter „Landlord“). The guest or the booking company accepts them as binding upon submitting the booking request or, at the latest, upon receiving the booking confirmation. They are made available to the guest prior to the issuance of the booking confirmation (e.g., via the booking link, by email, or via messenger). By confirming the booking, the guest confirms that they have read and agree to these terms and conditions.

Any conflicting or differing terms and conditions of the guest shall not become part of this contract unless the landlord has expressly agreed to their validity in writing.

1. Booking, Invoice, and Payment.

Booking Confirmation: Apartments are considered definitively booked as soon as a written confirmation of the booking/reservation (via email or messaging app, e.g., WhatsApp) has been received. Such confirmation may also take the form of the guest’s explicit agreement to a specifically stated time period.

Terms of Payment: Invoices are due immediately upon receipt and without any deductions, unless a different payment term is specified on the invoice. The payment term stated on the invoice always applies. The full invoice amount must be received in our account before check-in can take place. In exceptional cases, we may, at our sole discretion, accept a valid, binding transfer confirmation (via email) as provisional proof of payment and allow check-in; the obligation to pay in full remains unaffected by this. If payment is not received on time, we are entitled to refuse check-in until payment is received, without this affecting the payment claim or the cancellation policy.

Cancellation Policy: The reservation cannot be canceled. The full amount of the reservation is due on the date the invoice is issued and is non-refundable in the event of a no-show. If the guest does not check in for the booked stay or checks in only partially, the guest remains obligated to pay the agreed-upon fee; the landlord will deduct any expenses saved as well as any income generated from renting the property to another guest during that period.

2. Business Customers (B2B).

If the booking is made by a company, a legal entity, or a businessperson in the course of their commercial or self-employed activities, this constitutes a business customer contract. The person making the booking warrants that they are authorized to do so. The complete billing information (company name, address, and VAT ID number, if applicable) must be provided prior to booking confirmation. The above cancellation and payment terms apply without restriction to B2B transactions.

3. Arrival and Departure.

Times: Check-in is normally from 4:00 p.m. to 8:00 p.m., and check-out is by 10:00 a.m. at the latest. Different check-in or check-out times (earlier or later) are possible by separate arrangement. Please note that check-in may be delayed in certain cases—for example, if an apartment has not yet been cleaned. In such cases, our separate instructions for the day of arrival apply.

Delays: Check-ins after 8:00 p.m. may be subject to a separate charge. Guests who stay past the agreed-upon check-out time or who delay our cleaning procedures as a result are liable for all resulting costs and expenses.

4. Quiet Hours, Parties, and Smoking.

Smoking & Parties: Smoking, parties, and excessive noise are not permitted anywhere in the building. This expressly includes balconies, terraces, the area in front of the building, and common areas (e.g., hallways). Violations of the smoking ban will result in a fee of €250 plus the costs for special cleaning and damage repairs.

Rest periods: The legally mandated quiet hours from 9:00 p.m. to 6:00 a.m. must be strictly observed. Repeated violations of the quiet hours will result in a ban from the premises.

Photography & Illegality: Commercial photography and videography without the landlord's prior written permission, as well as any illegal activities, are strictly prohibited.

5. Occupancy and Animals.

Prohibited guests: Only the guests listed in the reservation are permitted in the apartment. We charge €35 per night for each unauthorized guest.

Animals: Pets are not allowed. Violations may result in a separate cleaning fee. Guests with service animals (e.g., guide dogs) are asked to contact us before their stay.

6. Cleanliness & Waste Disposal.

The apartment, the house, and the property must be kept clean. This also applies to shared laundry and drying rooms. Trash must be sorted in accordance with official regulations and disposed of exclusively in the designated trash bins. Please observe the municipality’s pickup schedules. All trash must be removed from the apartment before departure (see notices posted in the apartment).

7. Ventilation, Heating, and Energy.

Ventilation & Heating: The apartment and the bathroom (after showering) should be ventilated twice a day for a maximum of 5 minutes each time. Do not leave windows tilted or open continuously during the heating season. Always turn off the heat when a window is open. Avoid turning the heat up excessively (e.g., keeping it on level 5 all the time).

Electrical appliances: Bringing in and operating external large appliances or heating devices (e.g., space heaters, air conditioners) that are not part of the facility’s standard equipment is prohibited for fire safety and security reasons. This does not apply to standard small appliances such as charging cables, laptops, or hair dryers. Medically necessary devices are permitted upon prior arrangement.

Liability: In the event of a violation or an extreme increase in energy consumption, the tenant shall bear the resulting additional costs. In the event of serious violations (e.g., fire hazard), the landlord reserves the right to terminate the lease without notice.

8. Water.

Guests are asked to use water sparingly. Activities that lead to water waste (e.g., filling pools) are prohibited. Average consumption (according to Destatis) is 128 liters per day per person. If consumption significantly exceeds this amount, the guest may be charged for the additional costs. Leaks (e.g., dripping faucets, running toilets) must be reported to the landlord immediately. The guest is fully liable for water damage caused by negligence.

9. Internet Use (Wi-Fi).

Criminal offenses (in particular, unauthorized downloads, illegal streaming, or accessing prohibited websites) will be reported to the authorities. The guest is solely liable for any unauthorized use of the Internet.

10. Amenities, Inventory, and Keys.

Features: Each bed is equipped with the following linens: 1 bedding set, 1 bath mat, 1 shower towel, and 1 dish towel. Unauthorized removal will be charged at €14 per item.

Keys & Access: Guests are liable for the loss of keys, key cards, remote controls, or parking permits. We generally charge a flat fee of €250 per incident to cover the cost of traveling to and from the apartment to retrieve keys that have been forgotten or lost.

11. Checking Out of the Accommodation.

When leaving the apartment (even during the day), all windows and doors must be locked. In addition, all electrical appliances, lights, and the stove/oven must be turned off.

12. Optional Services.

The following services can be booked separately during your stay:

  • Bed linen change: €15 per set
  • Mid-stay cleaning: €120

13. Security & Access Rights.

Right of Access: The landlord and his representatives have the right to enter the apartments at any time, particularly in the event of imminent danger. When exercising this right, due consideration will be given to the guest’s legitimate interests. Whenever possible and reasonable, the guest will be notified in advance.

Security Systems: To monitor excessive noise levels, noise-level measurement systems (without voice recording) may be installed in the apartments. Video surveillance may be in place in the building’s common areas.

Reporting Hazards: Guests are required to immediately report any unsafe conditions or potential hazards in the vacation rental to the landlord.

14. Liability & Duty of Care.

Diligence: Guests are required to treat the property with care and are fully responsible for any damage caused by their actions. Any damage must be reported to the landlord immediately.

Landlord's Liability: The landlord is liable, within the limits of the law, for the safety and fitness for use of the apartment. The landlord assumes no liability for personal accidents involving guests, unless such accidents result from a breach of the landlord’s obligations. Likewise, the landlord is not liable for incidental, indirect, or consequential damages, unless these result from gross negligence or willful misconduct on the part of the landlord. It is recommended that you purchase travel insurance.

15. Lump-Sum Damages & Contractual Penalties.

In the event of violations of the house rules or damage to the property, the following flat fees will be charged. These fees will be billed to the person or company that made the reservation. Billing may take place during or after the stay, following an inspection by our cleaning staff. The guest expressly reserves the right to prove that no damage occurred or that the damage was significantly less; the landlord reserves the right to prove that the damage was greater. The right to assert further legal claims remains unaffected.

16. Final Provisions.

The laws of the Federal Republic of Germany apply. Should any provision of these Terms and Conditions be or become invalid, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by the applicable statutory provision. The place of performance is Günzburg; to the extent permitted by law, the place of jurisdiction for business customers is the lessor’s place of business.

Note: These Terms and Conditions are provided to the guest prior to booking confirmation and become an integral part of the contract upon booking. Versions in other languages are available upon request.
